1. General Provisions
1.1. This document constitutes the terms and conditions of use for the website pmushop.ge (hereinafter referred to as the "Terms and Conditions"). 
1.2. This document is a mutually binding agreement concluded between the user and "PMU Shop Georgia" LLC (Identification Code: 405831792, registered address: Apt. 26, N 8-10, Shroshi Street, Tbilisi). 
1.3. "PMU Shop Georgia" LLC shall hereinafter be referred to in these Terms and Conditions as "PMU SHOP". 
1.4. The Terms and Conditions of use of the PMU SHOP website, along with any amendments made thereto, the Personal Data Processing Policy, and other regulations, constitute a single legal document and shall be considered as a unified agreement concluded with the user. 
1.5. By registering on the website and/or placing an order, the user fully agrees to and acknowledges these Terms and Conditions, the Personal Data Processing Policy, and the Return and Exchange Policy, and consents to their legal force. 
1.6. If the user does not agree with the content of PMU SHOP’s legal documents, they have the right not to use the website. In such a case, PMU SHOP requests the user to provide feedback via the company’s email: info@pmushop.ge 
1.7. In the event of additional questions, complaints, or requests, the user may contact PMU SHOP via email. The PMU SHOP team is ready to provide a detailed answer to any questions the user may have.
2. Definition of Terms
The terms used in these Terms and Conditions shall have the following meanings:

• Account — A personal account registered by the user on PMU SHOP;
• PMU SHOP (hereinafter "We") — "PMU Shop Georgia" LLC, established in accordance with the legislation of Georgia, Identification Code: 405831792, registered address: Apt. 26, N 8-10, Shroshi Street, Tbilisi, Georgia;
• Website — The internet platform owned by PMU SHOP, located at the domain: pmushop.ge;
• Third Party — Any physical or legal person, or public institution, that is not a party to the agreement;
• User — A legal entity or a legally capable physical person who has reached the age of 18, registers on the website, and purchases products;
• User's Consent — The expression of the user's will regarding the familiarization with this document and the processing of their personal data;
• Direct Marketing — The direct and immediate provision of information to a data subject via telephone, mail, email, or any other electronic means for the purpose of popularizing goods, services, ideas, and/or initiatives, as well as establishing and maintaining interest in branding and social themes;
• Registration — The creation of a user's personal account on the website;
• Courier Company (Delivery) — A partner courier service provider company selected by PMU SHOP, which delivers the purchased products to the user.

3. Subject of the Agreement and Account Opening
3.1. By opening an account on the website, the user is given the opportunity to browse and purchase products displayed on PMU SHOP. 
3.2. Each order placed by the user constitutes a separate contract of sale, the parties to which are the website user and PMU SHOP. Upon placing an order, the object of sale, its cost, and delivery terms are generated automatically.
4. Registration and Security
4.1. To purchase products on PMU SHOP, registration on the website is required. For registration, it is mandatory to fill out the form by providing the following required data:

• Name and surname / Name of the legal entity;
• Delivery address;
• Email address;
• Mobile phone number;
• System login password. 

4.2. The user can register either during the product purchasing process or prior to making a purchase. 
4.3. The user confirms and warrants that:

• The information provided by them is complete, accurate, and up to date;
• They are a person of full age and legal capacity who has reached the age of 18;
• They will not use another person's information for the purpose of registering on the website;
• They will not use a username that is offensive, defamatory, or violates the rights of others;
• They will not use the website to disseminate false information or to impersonate another person/company;
• They will not use any device, software, or script for automated data extraction (Scraping/Mining) from the website or to interfere with the normal functioning of the website;
• They will respect copyrights and related rights; they will not make unauthorized use of the information (logo, pictogram, image, graphics, trademark, design) available on PMU SHOP without the prior written consent of the company;
• They will not engage in any action prohibited by applicable legislation, this agreement, and PMU SHOP policies.

5. Placing an Order and Purchasing Products
5.1. After placing the product in the virtual shopping cart, the user specifies the delivery address and contact details to complete the order. 
5.2. Prior to making the payment, the user is obliged to verify the address and contact information provided by them. In the event of providing incorrect or incomplete data, the responsibility for any delay or failure in product delivery shall rest solely with the user. 
5.3. PMU SHOP reserves the right to refuse to execute an order or to cancel it if there is a reasonable suspicion of fraud, provision of incorrect data, or an unauthorized/unlawful transaction. 
5.4. PMU SHOP is authorized to unilaterally set or change the minimum and/or maximum total value limit of an order. 
5.5. PMU SHOP reserves the right to cancel or refuse to execute an order in the following cases:

• Unavailability of product stock;
• Technical or system error;
• Risk of fraud or suspicious transaction;
• Other objectively justified circumstances that do not contradict the legislation. 

​​​​​​​5.6. The terms for exchange and return of purchased products are regulated by an independent document available on the website ("Return Policy"), which is drafted in accordance with the Law of Georgia "On the Protection of Consumer Rights".
6. Terms and Conditions of Delivery
6.1. The user agrees that the delivery of the products purchased by them will be carried out by PMU SHOP’s partner courier company.
6.2. For the purpose of providing courier services, PMU SHOP is authorized to transfer the personal data provided by the user—name, surname, delivery address, and telephone number—to the courier company. 
6.3. In accordance with the applicable legislation of Georgia, the risk of accidental loss or damage to the item passes to the user from the moment PMU SHOP transfers the item to the courier company. 
6.4. PMU SHOP will deliver the products to the user within the following timeframes:

• Tbilisi: 1 - 3 working days;
• Regions of Georgia: 3 - 7 working days. 

​​​​​​​6.5. The user is obliged to check the condition and compliance of the product with the order immediately upon receipt, and if the condition or compliance of the order is violated, immediately notify the representative of the website.
7. Order Cancellation and Settlement
7.1. If the user orders more than one product and decides to cancel one of them before the order processing is complete, the company is authorized to request the user to cancel the order in full and form a new order (due to technical necessity). 
7.2. Settlement on the website is carried out exclusively in non-cash form, through bank cards or other payment channels integrated into the platform. 
7.3. When placing an order, the user will be redirected to the secure page of the partner bank/payment provider. PMU SHOP does not have access to the user's bank card data and does not store it. 
7.4. Upon successful completion of the settlement, the user will receive an order confirmation notification on the website screen and at the email address provided by them.
8. Closing a Personal Account and Restriction of Use
8.1. If PMU SHOP considers that the user has violated these Terms and Conditions, registered with false data, or violated any other rule of using the PMU SHOP website, the company is authorized to unilaterally restrict or terminate their access to the website, about which the user will be notified via the email address specified by them. 
8.2. The user has the right to cancel their account at any time. If the "Delete Account" functionality is integrated into the website (or application), the user can utilize it. Otherwise, the user must contact the support team via email to request account cancellation: info@pmushop.ge
9. Limitation of Liability
9.1. PMU SHOP ensures the security of the platform to the maximum extent possible, but does not guarantee that the website will be continuously accessible, free of errors, viruses, or technical faults. 
9.2. PMU SHOP is not responsible for delays caused by the operation of third parties (including internet service providers, mobile operators, or payment systems). 
9.3. PMU SHOP disclaims liability for any damage caused by the user's transfer of their authorization data (password) to third parties or by negligence. 
9.4. In any case, if the culpable liability of PMU SHOP is established by a court, the maximum limit of compensation for damages shall be limited to the amount of the cost of the disputed (purchased) product.
10. Direct Marketing
10.1. For the purposes of direct marketing (sending promotional materials, discounts, and news via SMS or email), PMU SHOP will use the user's personal data (name, phone number, email) only in the event of prior, voluntary, and active consent expressed by the user. 
10.2. The user has the right at any time, without any fee or restriction, to withdraw the consent granted for direct marketing. 
10.3. Withdrawal of consent is possible from the user's profile by disabling the corresponding button. PMU SHOP will stop direct marketing no later than 7 (seven) working days from receipt of the request. 
10.4. Discontinuation of marketing messages does not oblige PMU SHOP to stop sending system and service messages (e.g., order status, password reset, changes to rules).
11. Intellectual Property and Copyrights
11.1. Any text, design, graphics, animation, logo, and trademark placed on the website constitutes the exclusive intellectual property of PMU SHOP ("PMU Shop Georgia" LLC), which is protected by the Law of Georgia "On Copyright and Related Rights". 
11.2. Purchasing products on the website does not transfer any copyright or intellectual property rights over the elements of the platform to the user. 11.3. Unauthorized use of PMU SHOP’s trademarks and graphic images, copying for commercial purposes, or any reproduction is strictly prohibited and shall entail liability provided by law (including the obligation to reimburse attorney and court costs).

12. Governing Law and Dispute Resolution
12.1. These Terms and Conditions shall be governed by and construed in accordance with the applicable legislation of Georgia. 
12.2. The parties agree that in the event of any disagreement, the parties shall attempt to resolve the dispute through negotiation. 
12.3. In the event of failure of negotiations, the dispute shall be referred to the court for consideration. 
12.4. Invalidation of any clause of this document (for example, due to a change in legislation) does not cause the invalidity of the entire agreement or its other clauses.

13.1. PMU SHOP reserves the right to unilaterally make amendments and/or additions to this document at any time. Amendments shall enter into force from the moment of their publication on the website.
​​​​​​​13.2. The company will notify the user of significant changes through the website or email. Continued use of the website after the publication of amendments shall be deemed as the user's consent to the new terms.
